The Resolution Trust corporation was an excellent way to use private capital and entreprenuers to be invalved in gaing the most value for the troubled assets of failing S&L's. No seizures of property by the government or the banks, without due process, were involved.
The RTC should have been used to deal with the banking crisis but progressive thinkers thought it better to spend public money (we didn't have) to reduce the pain resulting from the greed and stupidity of the Sub Prime Mortgage debacle.

Now, exactly what has that to do with, the fifth amendment, what I said, and which you quoted?

Have you looked at the "eminent domain" clause in the Fifth Amendment? That kind of sets the parameters for what is due process, what can be taken and what is fair value. That's how my discussion of Resolution Trust ties into the discussion.

The Constitution seldom lays out processes and procedures directly. It simply directs enabling legislation to be crafted or written. If the legislative and executive branches get it right, then it's all good. If they don't, the courts smack it back. It's the worst way possible of doing something, except for all the other systems of governance humanity has tried out over the years...

 

The private sector has all kinds of cash. Just no place to put it where the rules of engagement are clear.
