Go after the "shop" and demand compensation for the missing windshield frame piece. BTW, you didn't mention whether you have a coupe or roadster, since that part is different those models.

The coupe's top windshield part has 2 rubber strips, one at the top, since it rests against the actual roof line and one at the windshield. This rubber prevents rattles and most importantly any water seepage between the trim and the roofline. The roadster model only has one rubber strip, against the windshield.

Its already been past a month, get er done sooner rather than later. The hard part would be getting another shop to write down (on a repair ticket) that the 1st shop screwed the pooch on this. If you get that it should be a slam dunk. Good luck!
