Boy do I have a story for you guys. First of all I am a 23 year old male that came from a relatively poor family. I worked my butt off to get awesome grades my whole life and I graduated with a bachelor’s degree in MIS. I worked my whole life for this car and I love it. So, on to my terrible story…..
I was at Blockbuster on Saturday night trying to have a nice low key night. When I pulled into the parking lot (4 rows back so no one could ding my car) I noticed the vehicle of this girl that used to stalk me. She was so bad that I had to permanently kick her out of the community center I used to work at. I didn’t really worry about it though because that was over a year ago, so I proceeded into the store. But while looking for a dvd I got the bright idea to look out the window and check on my car. And guess what I saw, it was that little b!tch keying the back of my car. Rather then go outside and bash her head into the curb I decided to play it safe and get the year and make of her car and a description of her. She drove a 02-04 Cavalier that was burnt orange in color. I knew her name and where she lived from when I kicked her out of the community center. So after she peeled out of the parking lot, I called 911. I told them that I needed an officer to come to Blockbuster to write up a police report. The 911 dispatcher told me this wasn’t an emergency and I needed to find a cop. So I walked across the parking lot to No-Frills (a grocery store) and talked to the cop there. He asked me if I called 911 and I told him I did and they said to find a cop. He said he couldn’t help me because he was arresting a kid for shop lifting and I should call 911. So after getting the run around for 15 more minutes I finally got a voice recording to leave the crime and my name and number. Well finally on Monday, two days later without sleeping because I was so infuriated the police called me back. I had them fill out a police report over the phone because they still refused to send an officer to see me. After filling out the report I asked them what would happen and the officer said probably nothing since it is my word against hers. So, basically they are penalizing me for not bashing the girls head in and dragging her in Blockbuster and making the cops come because of the assault. I believe someone had a post about cops and how much the serve and protect not to long ago. To me this doesn’t sound like serving or protecting as much as it sounds like penalizing someone for doing the right thing. So I am hoping someone on this forum is a police officer or lawyer and they can give me some advise. I really don’t know what to do because I don’t want any of the costs to come out of my pocket (i.e. I don’t want to have my insurance go up after they fix the paint job or have it come out of my pocket to pay for the fix in the first place). My car is keyed extremely deep across the hood, to the driver’s front fender, across the door with a ‘M’ on the door, up the back fender and across the spoiler. Please help me out with some solid advise because I am going insane over how a stupid immature female can ruin my car and not be responsible.

hey man, those shopping centers usually have security cameras, i know i nailed someone for a hit and run on me a-holes lol, so just ask around the shopping center stores if they keep cameras. If so, then show it in court and the bit*h is nailed! I did the same thing, her lawyer said that she wasn't even there. Then my lawyer showed the tape and the bit*h was left speechless.

If you got her license number and actually witnessed the crime you should be able to take her to small claims court. It is usually for amounts under 10,000 dollars and the magistrate makes the ruling. Both of you testify under oath and the cost is about $75.00 which will be added to the repair bill if you win. You actually do not need a lawyer and the most you can lose is the $75. Maybe this will keep her from doing it again when she sees you are not letting it go. Good Luck!

Filing a claim with your insurance company is a good idea. The claim may be under the comprehensive coverage, so you may have a smaller (or no) deductible.
Going to small claims court is also a good idea. I don't know the procedure in your state, but ultra sport gives a pretty good general description. In most states, you can actually file the claim with your insurance company, get the payment from them, and still get a full recovery from the person who caused the damage.
On a personal level, you should probably learn to deal with people without needing to "bash" their "head into the curb". You could have saved yourself a lot of trouble by simply telling her to stop without allowing the exchange to escalate into a physical confrontation.

Palmer...wow, i wont call you names, but i really should...jwheeler, the same thing happened to me with some punk as* kids at a golf course, luckily it wasn't my crossfire. they were hitting the driving range ***** into the parking lot and i watched them nail my truck, i went grabbed all his clubs and called the cops, his mom ended up coming down and took the clubs from me so i tried to file charges on her when the cops came TWO HOURS LATER, nothing ever came of it, i ended up repairing the giant dent with my own money, so if i ever see anyone touch my car again rest assured they'll regret it. never rely on the law, that's the lesson i got out of it.

Sorry Dan, you're just plain wrong, as is so often the case.
An 18 year old, living at home and being supported by parents, can sign contracts and be held accountable for them and NOT the parents NOT be held accountable for them just because they're supporting them. It's called the age of majority, look it up.
That goes to consequences for the actions such as vandalism damage as well.
Look at credit card companies. They target 18+ year olds all the time. 18 year old living at home off mom and dad runs up a credit card bill (in her name) does NOT make the parents liable for the debt. Again, it's the same for any damage the person may do in an act of vandalism.
Credit card companies all the time give credit cards to kids with no visible means of support other than their parents, while in school to use your example.
If the kid is driving her own car, in her name, and insured ONLY in her name. Wrecks it, does property damage beyond what insurance will cover...the aggrieved cannot go to the host parent for recourse...only the kid. That's even if mom and dad are paying all bills and putting a roof over her head.
But as always, Dan, you never let anything like facts get in the way of what you post.

Sorry to hear that dude. My car was keyed on every single panel over new years eve whilst on my own drive. No idea who did it so the police didn't want to waste their time filling out a report! My insurance paid up and then when my renewal came through they put it up by £400!!!! Cheeky gits.
If the parking lot has video cameras get on the case quick as they probably have some kind of rotation and it could be overwritten in a week or so.

Sorry adult at 18-25 here at home under parents roof means they are supported by parents and the parents can be found liable. But not for credit issues or contracts signed by young adults as that is a personal debt..only for loss or destruction of property or possibly car accidents! Especially since the parents probably have bought it for them and have them insured on their policy. but, i know for fact that parents can be sued for their in home 18 years -25 going to school and being supported by their parents! You might want to ask any college who pays for damage at their rowdy parties dah!?

Man, I really appreciate all of the great advice. It sounds like small claims court is the way to go. Palmer, if I went out and asked a girl to stop keying my car do you really think that would matter and the situation wouldn't escalate from there? I think if she is crazy enough to key my entire car, it might make the situation worse if she was confronted. And the worst part is I did what police officers have always told the public to do, get a description of her and her car. And now after following the police way for citizens, they are telling me it might be my word against hers. It just seems like a no win situation for the victim.
I think I will file a claim with my insurance and then let them take her butt to court to get the money back. I will press charges as well, because it is a felony in Nebraska if the cost is more than $1,500. My estimate was actually $2,200, not including the rental car I would need to get. I really hope my car gets back to its normal beautiful look. I never thought I could feel trashy in a 36,000 dollar car but when it has key marks all the way across it you actually do. I thank all of you for your words of wisdom and I will keep you updated.

I personally would have told the blockbuster clerk to call 911. I'd go out there and restrain her *** til they showed up. In texas we're allowed to carry weapons. I doubt she would have had any issue waiting patiently for the police to show up. Especially with the help of a gun.
Women are crazy man. Sucks 911 didn't want to show up. I guess it just depends on the area.

You and I seem to live in two different worlds. Of course I think that if you approached someone "keying" your car and told them to stop your words would have the desired effect! Most people, when caught committing a crime, will stop. If not, then you make enough noise to attract attention. At the very least, you would then have additional witnesses so it wouldn't be a "he said, she said" situation. I don't see how the situation could escalate unless you participated in the escalation.
