Kim is OK, as am I, but she's still got a bruised foot from the sprain and her back is in a great deal of pain. This was documented on the ER visit one hour after the wreck, and the police report indicates the same. I have an annoying "twinge" in my back between my shoulder blades but nothing as painful as what she's experiencing.
Farm Bureau is covering it all and they waived my uninsured deductible, so at the moment I'm out-of-pocket $0. My agent said they would sue him for the damages and suspend his license until he pays.
Kim and I are considering an attorney as well. Basically have to present the facts to him and see if it's worth messing with (I hate the thought of suing someone but it's been advised for me to do so by countless folks). I'm not looking to get a yacht, I just don't want to be paying Chiropractor bills ten years from now for the injuries sustained in this wreck.

The only claim you really have John is with your own carrier for uninsured motorist. of course you can sue the other driver and obtain judgment, but collecting on that judgment is a different issue altogether. That's why I've beeen making such a fuss about the lack of personal responsibility that we seem to have found acceptable today. It's just not right. BTW, there were a few members who were really warm and caring individuals who expressed deep concern for the hardhips sustained by others, and yet, odd, I see no trace of them here to express their concern for one of their own who lost a dear friend and sustained injury. judgements, well, yes the court will order a person to pay, but will the same judge put them in jail when they don't? Not likely...over crowding, more serious crimes out there... I have a good friend I helped gain a judgement in their favor, but have to repeatedly bull...the guy into paying each month. I know the court won't do anything, but....lol....it is getting done... John's insurance will take care of him, hopefully the other guy won't drive until he can afford to...but it is a serious problem with the economy and all. Many violators out there...sometimes it is eat, or pay your car insurance...doesn't make it right I know...no easy answers here...

Good luck with settling. I am close to the 2 year mark from my accident. All along the way, my Safeco adjuster has been saying they would build in future medical, pain & suffering, etc. The offender's policy maxed out barely covering wrist surgery, physical therapy, chiro, time off, mileage. My back is wrecked & my right arm has shrunk from not being able to use it the same way.. My adjustor offered me five thousand. I laughed at her. Now I have a new adjustor. Again. It feels like I am in a car dealership.
People think having insurance, however inadequate, absolves them of responsibility. I have seen the girl driving around town twice, both times on her cell phone. It really amazes me.

I believe you have only 1 year in TN, John to file suit if that's where this is going, but I suspect it won't. That's not alot of time to sort out real injury from healing, but just letting you know. To protect your overall rights, you'd have to file suit then from 1 year, I'd advise at the outside 11 months from the date of loss, and hen at least you have plenty of time to get it sorted out. I personally would not recommend settlement now, just wait to ensure that everything's cool. You have time for that. OTOH, if you are fine and healed and all that, then of course your claim gets devalued and would only be based on the period between injury and being done, but it would likely be in the same value as if you settled now anyway.
